A c(c) violation occurs when the consumer has stated in writing that they refuse to pay the debt in question and the collector subsequently contacts the consumer in connection with the debt. In order for this to be brought to an attorney though you must be able to provide proof that the debt collector received the letter.
1) Use this template for collection accounts.
2) Include the DOB and full SS #. (Without this the collector can fight and say that they were not able to locate your file based on lack of information)
5) Send certified.
6) Collect any type of response you receive (debt validation, proof of a call, settlement offer, etc).
7) 35 days after you have confirmed the receipt of the letter, check the credit report for the notation of the account being marked in dispute.
8) Also check the credit report for any further updates to the reporting of the account. (balance change, activity change, etc.)

When you have received a fresh collection letter from a collection company, send this letter certified directly to the collection company within 30 days of the receipt of the collection letter to force them to validate the debt.
In a goodwill letter, you ask the creditor that reported your late payments to remove the derogatory mark from your credit reports. Maybe you had an unexpected change of circumstances or financial hardship. Whatever the situation, your goal is to explain why you missed your payments and why the creditor should wipe them from the report.
(Note: If a credit report incorrectly says that you missed a payment when you did not, you should dispute the error instead of sending a goodwill letter.)
A strong goodwill letter asks the creditor to empathize with you. It’s pleasant and courteous. It shows that you take responsibility for your missed payments and demonstrates that you’ll stay current on your bills in the future.
It helps if you can point to a specific circumstance (for example, you lost your job but have since found a new one), or if you can show a recent track record of on-time payments. Keep it short and sweet.
Once you’ve written the letter, email it directly to the CEO of the creditor. You might have to contact the creditor multiple times or follow up with a phone call. Persistence may help persuade them.
